The suit in
Charlotte Mecklenburg County, NC alleges and gives 20 specific instances of the
Verdults slandering and libeling both the Corporation and Alton Perkins. The
suit outlines a case of malicious slander and seeks an injunction, damages,
special damages, and punitive damages against the Verdult’s.
The suit outlines
how the Verdults voluntarily dismissed an earlier action in the Court in
Mecklenburg County, NC and failed to pursue a follow-up remedy. The Verdults
were well aware that their statements were false and libelous making the
Verdults actions malicious defamation.
The suit further
points out how the Verdults engaged in
acts of defamation per se which means just making such allegations with
no basis – is extreme defamation where harm does not have to be proven, the act
alone proves harm.
The law suit
outlines how the Verdults repeatedly made false oral and written statements and
published theses statements on the Internet alleging criminal conduct and
investigations by the FBI when the Verdults were well aware that no such action
was taking place. The suit further asserts that the Verdults were attempting to
harm the Corporation and Perkins at all cost using defamation over the Internet
to achieve an objective which the Verdult’s were unable to achieve in a Court
of law.
The suit shows how
the Verdult’s were both malicious and negligent in each of the twenty instances
of defamation, “the Defendants grossly failed to follow the most rudimentary
elements of good journalistic practices and did not meet minimally acceptable standards
to avoid being negligent.”
The suit shows how
the Verdults even made false statements to other government agencies in
California causing them to take unnecessary and damaging action against the
Corporation and Perkins. Now the Plaintiffs have to spend unnecessary time and
resources to correct the wrongs done by false statements.
The suit points out
because of the Defendants (Verdults) egregious and malicious actions and the
medium they have chosen, the Internet; they should be immediately enjoined from
publishing further libel and slander and that damages, special damages, and punitive
damages be awarded to the Corporation and Perkins in excess of $1.5 million.
The suit illustrates
how Internet defamation is different than traditional written forms of
defamation since online defamation, or “cyber libel”, is often taken at face
value, and is capable of instantly reaching an unlimited number of persons
around the globe.
